Every expatriate who wish to work in Indonesia must obtain Work Permit, which consist of various legal documents obtained from the different government institutions (i.e. Manpower Department, Immigration etc). The first step to obtain a Work Permit is to submit RPTKA (Rencana Penggunaan Tenaga Kerja Warga Negara Asing) or Expatriate Manpower Utilization Plan to Manpower Department (Departmen Tenaga Kerja), in accordance with the Manpower Act No. 13 of 2003. Based on the approval of RPTKA the applicant will be able to file a recomendation (TA-01) to the manpower department, which further will be used to obtain (VITAS) Temporary Stay Permit from Directorate General of Immigration. In Foreign Investment Company (PMA), for senior designations (i.e. Director, Commissioner etc) Work Permit is valid for 3 years and can be renwed before expiration. While for other Designations work permit validity is 1 year and can be renewed.
Typically, RPTKA consist of details of the company wish to hire expatriate staff, and tables with details of all positions held by expatriate employees in the company. So if the company is applying for the position of additional foreign workers, it is necessary to submit a copy of the last RPTKA with new one. If the new RPTKA is accepted by Manpower Department, the old one will be discarded itself. For the temporary positions (less than 1 year) a separate copy of RPTKA is issued alongwith original copy of RPTKA (for positions 1 year or more) to the same company.
The documents required to obtain RPTKA are as follows:
- Fully filled RPTKA application form
- Copy of Passport (Passport cover, Photo and Personal data pages) of applicant
- Copy of Curriculum Vitae (CV) of applicant
- Copy of Degree/Diploma of applicant
- Copy of Identity card (KTP) of Indonesian companion (Tenaga pendamping)
- Description of Job Title of applicant
- Location of work (Jakarta pusat, Jakarta Barat etc.) of applicant
- Organisational structure of Sponsor company
- Letter of Appointment from Sponsor Company
- Copy of following Sponsor Company Documents:
- Akta Pendirian Perusahaan (Article of Association)
- PPM (Investment Board Permit)
- Surat Domisili (Domicile Certificate) according to the work location of applicant
- NPWP (Tax Number)
- TDP (Business Registration Certificate)
- SK Menteri (Deed of Establishment)
- IUT (Permanent Business License) or Izin Prinsip
- Wajib Lapor (Compulsory Company Report)
